Named COVID-19 by the World Health Organization (WHO) in February 2020 short for “coronavirus disease 2019,” it has spread throughout the world, including every state in the United States. WHO declared COVID-19 to be a Public Health Emergency of International Concern. On March 12, 2020, Wisconsin Governor Tony Evers declared a public health emergency for the State of Wisconsin. The following day, U.S. President Donald Trump declared the COVID-19 outbreak a national emergency. On March 25, 2020 a Safer in Place Order was issued by Governor Evers, which required the public to stay at home and practice social distancing-the practice of keeping at least six feet apart from others and avoiding direct physical contact with others-resulted in all Wisconsin schools not only suspending all in person instruction but also, all spring sports and extracurricular activities. On April 21, 2020, all spring sports and activities were canceled for the remainder of the 2019-2020 school year. On June 22, 2020, the Wisconsin Department of Public Instruction published a guidance document entitled Education Forward for Wisconsin school leaders to use as they plan for a safe, efficient, and equitable return to school for the 2020-21 school year amid the continuing COVID-19 pandemic. Given the widespread outbreak and the possibility of COVID-19 being contracted, federal, state, and local governments, and federal and state health agencies, recommend social distancing and have, in many locations, prohibited or limited the congregation of larger groups of people. As a result, Catholic Memorial High School (CMH) has put in place preventative measures to reduce the spread of COVID-19. Even with these measures, CMH cannot guarantee that its student athletes, students participating in extracurricular activities, their family members, coaches, staff, or community partners will not become infected with COVID-19. Catholic Memorial reserves the right to update rules and procedures surrounding participants as suggested or required by officials on the local, state, and national level. By signing this agreement, the parents/guardians and students involved in extracurricular activities agree that: 1.Use of CMH facilities and equipment during any sports and other extra-curricular activities is voluntary. 2.Participating students and their parent/guardian acknowledge and understand that CMH is subject to the guidelines set forth by various organizations including but not limited to the WIAA, Athletic Conferences, performing arts organizations, First Robotics, National Honor Society, and others. 3.Participating students and their parent/guardian acknowledge and understands that, due to COVID-19 and beyond the control of CMH that athletics seasons or other curricular activities may be canceled. 4.While at CMH facilities and using CMH equipment and resources, all safety and social distancing protocols as prescribed by local, state and national authorities shall be followed. 5.Students will not use the facilities or equipment if his/her temperature is above the specified temperature (currently 100.4 degrees Fahrenheit) on any day that the student is to participating any activity, or if the student has been exposed to any person who has tested positive for COVID-19 for a minimum of fourteen (14) days. 6.COVID-19 is highly contagious, in part because it can be transmitted by individuals who do not have any symptoms, and the participating student, and his/her parent/guardian as applicable, understand it is the sole responsibility of the participating student and his/her parent/guardian, to evaluate carefully all risks inherent in using CMH’s facilities and equipment. The participating student and his/her parent/guardian as applicable voluntarily assumes full responsibility for the risk that the participating student may be exposed to or infected byCOVID-19 by using CMH’s facilities and equipment, and that such exposure or infection may result in personal injury, illness, permanent disability, death or other damages or expenses not only to the participating student, but also to the family members or other persons the student athlete comes in contact when not using CMH’s facilities and equipment. 7.The risk of becoming exposed to or infected by COVID-19 at CMH facilities may result from the actions, omissions, or negligence of the participating student or others, including, but not limited to, other students, student athletes, coaching staff, teacher advisors, volunteers, and guests; 1.Although the CDC and federal, state, and local health departments believe preventative measures are important for reducing the spread of COVID-19, no one can guarantee that individuals will not become infected with COVID-19 even when preventative measures are taken. 2.The participating student, and his/her parent/guardian as applicable, assumes all risks associated with participating in extracurricular activities, including all of the foregoing risks and accepts sole responsibility for any injury including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind, that the participating student or their parent/guardian may experience or incurring connection with participating student use of CMH facilities or equipment (“Claims”). 3.The participating student, and his/her parent/guardian as applicable, releases and agrees to hold harmless and indemnify CMH, its members, employees, officers, directors and agents, from any and all liability, arising from negligence or otherwise, and any damages as a result of the participating student’s use of CMH’s facilities or equipment, including but not limited to property damage and any mental or physical bodily injury, and including death. 4.This release includes any Claims based on the actions, omissions, or negligence of CMH, its members, employees, officers, directors, agents, and representatives, whether a COVID-19infection occurs before, during, or after use of CMH’s facilities or equipment. 5.The foregoing WAIVER OF LIABILITY, ACKNOWLEDGMENT, AND ASSUMPTION OF RISKAGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of Wisconsin and that if any portion thereof is held invalid, it is agreed that the remaining provisions of this Agreement shall, notwithstanding, continue in full legal force and effect.
